Indian Takeaway Threatened With Legal Action Over Its Name
An Indian Takeaway owner in Chesterton, near Maidenhead has been accused of breaching a trademark which is owned by a restaurant 150 miles away from his.
Beta UK, which run “Malik's Tandoori” restaurants in Cookham and Buckinghamshire have given Mr Ali until Friday to change the name of his takeaway, or face court action.
The Malik's Tandoori near Maidenhead was named the Best Restaurant in the South-east at the British Curry Awards in 2005, 2006 and 2008. Its visitor book is signed by celebrities including Peter Andre and Jordan, Kelly Brook and Glenn Hoddle
The solicitors representing Beta UK have said that the firm has the trademark rights to “Malik” and believe that the accused is using the name to make a profit.
In the past there has been disputes against other restaurants using the name Malik, however they were not pursued as Beta UK were satisfied that the owner was indeed called Malik – which isn’t the case in this instance.
The accused Mr Ali, commented that he thought it was a joke when he first received a letter from a solicitor, adding that Malik is a very popular surname, much in the same way as “Smith” and that four of his children share this name.
He went on to say that he has invested a lot of time and effort into advertising and building up the reputation for his business, having to start that again due to a name change could really damage his livelihood.
